Trademark Licence Agreement

If you own a trademark it is essential that you protect its value by only allowing third parties to use the trademark under the terms of a written licence agreement. If no written licence is put in place then you expose yourself to the risk that an implied licence can come about as a result of the third party's continued use. The uncertainty over the terms that a court will imply into such a licence makes this very risky for the trademark owner. Such risk can be avoided by putting in place a Trademark Licence Agreement that sets out the extent of the rights that you are prepared to grant to the licensee over your trade mark.
