You probably have an idea of what a trade mark is, but have you thought about trademarks and how they work? A trade mark is a sign or indicator an individual, business, or organisation can use to identify a product or service. There are different types of trademarks which designate whether it is registered or not. An unregistered trademark for brands will have a TM behind it. A registered trademark for services will have SM, meaning service mark. The R with a circle around it is the registered trademark for all other branded products. A trademark lets someone know that you own the intellectual property such as the name, word, phrase, symbol, logo, design, or image. There are also a range of non- conventional trademarks that exist.
The owner of a registered trademark has legal actions that they can take against trademark infringement. Trademark infringement is when a person or other company uses a trademark without the legal right to do so. Unauthorised use of trademarks has been pretty common over the last two centuries. The laws regarding trademarks have had to be changed, reformed, and made clear in order to protect the trademarks. For example trademark issues have cropped up regarding online use of logos, images, etc. because it is easy for a person using the internet to recreate the trademark, and for it to go unnoticed for quite a while.
The fundamental concept of trademarks is to exclusively identify a product or service that belongs to a business. Trademarks identify certain parts of that business, which allows the consumer to have more confidence in the products. A registered trademark typically means the company has been around for a while and that they care to offer their information for the consumer. It gives a feeling of confidence, and helps in legal proceedings if the confidence is shaken. It also helps in keeping trademark infringement under control. Trademarks date back to the Roman Empire, which means they are quite old.
Above all trademarks that are registered is a bundle of exclusive rights dealing with that symbol, logo, etc. that the owner can exercise if need be.
