Lodger Tenancy Agreement with Guarantor Clauses

Our lodger agreement is suitable for use where the landlord lives in the property and is renting out a room.  There are a number of different types of Tenancy Agreements and situations one can be in. In the traditional setup a tenant rents a place that is wholly separate from the landlord. A Tenancy Agreement or Assured Shorthold Tenancy Agreement is often used for this type of setup. However, there are other types of tenancy situations you might consider. The Lodger Agreement is designed for a tenant who is renting a room from the landlord who lives in the property.

The Lodger Agreement creates a licence between the lodger and landlord establishing the rights of each and what is acceptable. For example in a tenancy situation the place being rented by the tenant is not accessible to the landlord unless prior notice is given; however in a Lodger Agreement this may be different. The lodger may give consent for the landlord to enter the room for cleaning purposes and switching out the lights or changing linens and towels. It does depend on what the landlord is offering in the room. The landlord may state that the cleanliness of the room is the responsibility of the tenant.

There are two types of Lodger Agreements; one that has a guarantor and one that does not. Here we will discuss only the Lodger Agreement with Guarantor. The guarantor is a person who “backs” the tenant. In other words if the tenant is unable to fulfil their obligations such as paying the rent the guarantor will have to fulfil the obligations. A landlord can require that the lodger have a guarantor based on their previous rental history or income. If the tenant’s history is not strong the landlord may feel it is necessary to have another person responsible in the event the tenant has a time of hardship. The higher risk tenants are often asked to sign the Lodger Agreement with Guarantor for renting a room in the same property. The landlord using this document is then protected against anyone who fails the obligations.
