Lodger Tenancy Agreement with Guarantor

The Lodger Tenancy Agreement is suitable for use where the landlord lives in the property and is renting out a room to a tenant. In a traditional renting arrangement, a tenant rents a place that is wholly separate from the landlord. A Tenancy Agreement or Assured Shorthold Tenancy Agreement is often used for this type of setup. However, there are other types of tenancy arrangements that you might consider. The Lodger Tenancy Agreement is designed for a tenant who is renting a room from a landlord who also lives in the property.

The Lodger Agreement creates a licence between the lodger and the landlord, setting out thr rights and obligations of each.  For example, in a normal tenancy situation the property being rented by the tenant is not accessible to the landlord unless prior notice is given, however in a Lodger Agreement this may be different. The lodger may give consent in the Agreement for the landlord to enter the room for cleaning purposes or to switch out the lights or change linen and towels. The landlord may wish to include an obligation that the cleanliness of the room is the responsibility of the lodger.

There are two types of Lodger Agreements; one that has a guarantor clause and one that does not. This Agreement includes provisions to appoint a guarantor. A guarantor will provide security for the landlord. If the lodger is unable to fulfil their obligations, such as paying the rent, the guarantor will have to meet those obligations on behalf of the lodger.
