Assured Shorthold Tenancy Agreement with Guarantor

In any tenancy situation it is always best to have a written document in place to set out the terms and conditions of the tenancy that the landlord and tenant have agreed upon. This can then be relied on should a dispute arise between the parties, as it will have been signed by each party. 

A commonly used document for tenancy arrangements is the Assured Shorthold Tenancy Agreement (AST). This version of the AST includes an additional clause for the appointment of a Guarantor, to provide the landlord with extra protection regarding the tenant's obligations. The Guarantor is responsible for any obligations that are not met by the tenant. A landlord has the right to request a Guarantor if there is a high probability that the tenant may be unable to pay the rent.  If the tenant fails to fulfil their requirements,  the landlord will call upon the Guarantor to fulfil them instead. Typically students and individuals with no guaranteed income are asked to have an Assured Shorthold Tenancy Agreement with Guarantor. A person who has a steady income with a bad tenancy history or credit scores may also be asked to sign the agreement with a Guarantor.

Under the laws of England and Wales, the landlord has the right to protect him or herself from a tenant that might not be able to pay. Instead of completely rejecting a tenuous situation with a student or other person, the landlord can simply request a Guarantor.
