Late Payment Chaser Letter
When it becomes necessary for you to recover debt there is a process you must follow. The process has been court approved as a legal method to remind debtors of their obligation to you and your company. At any time that you need to seek late or missed payments you can use this process to show that you are in control of your debts and actively pursuing the money you are owed. There are steps to the debt recovery process. The first step is the Debt Reminder Letter. However, if the Debt Reminder Letter proves unsuccessful you will have to move on to step two.
Step two is the Late Payment Chaser Letter. The letter must be used after you have sent the Debt Reminder Letter and there is no fixed period between the first and second letter according to the laws of England and Wales.
Of course, you should use your discretion when sending out the second letter. It could simply be that the letter was received and the client did indeed forget to make payment. If you send out the Late Payment Chaser Letter too early you could find the payment has crossed in the mail with the second letter. Only you will know the appropriate time to start the second step, but if you wish to use the client in the future and this is the first instance of problems you may want to give them the benefit of the doubt.
The Debt Reminder Letter usually states that the debtor has seven days in which to comply regarding payment. This could mean that they have seven days to reply to your letter with the payment or at least to call you and tell you when payment should be expected. This means you should wait at least eight days before the Late Payment Chaser Letter is used. The second letter will provide another seven days for the date to be paid before you will send out the third step in the debt recovery process.
If the debt recovery process makes it to the final fourth step and payment still has not been made you have a legal stand to attempt to recover the funds through the court. The court will want to see that you actively moved through the debt recovery steps with the proper paperwork and that you allowed reasonable time for the funds to be paid. By sending out the Late Payment Chaser Letter you are providing proof of the second step in the process.
