Copyright Licence Agreement

A Copyright Licence Agreement is designed to give permission to use material that has a copyright to a third party. A copyright protects a business from other individuals using their materials. For example if you have written material you do not want copied or reproduced you can copyright it. The copyright protects you by law so that you can prosecute any individual who may be using your material without permission. The Copyright Licence Agreement clearly states who you have given permission to use the document. The licence you put in place will help you regulate the material more.

Sometimes a copyright is mistaken for a trademark, but you should know that there are different symbols. The Copyright symbol is a C with a circle around it ©. This allows the other individuals to know that your material has been copyrighted and therefore is protected against use without permission.

Even in a business the original creator will hold the copyright to the material. If you are not the creator of a product or idea you will need to use the Copyright Licence Agreement to obtain permission to use the copyrighted material. If your contract clearly states that all employee ideas are that of the business rather than the creator then you will be the one to hold the copyrighted work. Most often a business makes it clear that all ideas created in the line of work are theirs rather than the employee’s. After all, an employee has been hired to create those ideas for the business.

If you offer permission to another individual to copy something you are usually providing only a small part of the copyrighted work rather than the entire work. However, there are times a person can use copyrighted work without permission. For example, a person that quotes written material properly can use the work without copyright permission because they have given credit to the owner of the work. Most often in a business quoting material is not used often.

However, if a portion of the material not included in the agreement is used this would be infringement. At anytime when you use the Copyright Licence Agreement it is imperative you are extremely clear in what parts of the work can be copied. If the licence agreement is left open to interpretation it is possible for the person to gain more information than you wish them to. You would also be limiting your legal stand if you are not clear.
