Reclaim Credit Card Charges Kit
It is estimated that credit card issuing companies have already paid out over half a million pounds to consumers for unfair credit card charges.
The Office of Fair Trading ruled in 2006 that penalty charges and fines for credit cards of over £12 were unfair. In England and Wales you can reclaim up to six years of credit card charges and fines. In Scotland you can claim up to five years. These time limits have been set by law.
The credit card penalty charges and fines that you may reclaim using this kit include interest and fees incurred for late payment or for going over your credit limit. You cannot, however, reclaim standard account fees or interest using this letter.
If you do not have in your possession your previous year’s credit card statements, you are legally entitled to request copies of these from your credit card company under the Data Protection Act 1998. The credit card company may charge you a nominal fee for administration costs in providing these. Using our template letter, you can then contact your credit card company, setting out your past charges and request that these payments be reimbursed to you.
If you incurred credit card penalty charges of, for example, £35, you may only be entitled to receive the difference between your charge and the £12 limit, which would result in a £23 reclaim. However, if you want, you can push harder to get the full amount refunded or complain to the Financial Ombudsman. Charges incurred before June 2006 were generally set at £30. Therefore it is likely that you will receive the difference between this charge and the recommended £12.
Credit card companies have been repeatedly accused over the last seven or more years of making unlawful charges. Consumers have launched numerous cases and the United Kingdom courts have begun to take notice. Several court decisions have ruled that consumers could recoup unfair charges from credit card companies.
The Reclaim Credit Card Charges Kit provided on this site gives provides you with a way of claiming the unfair charges that you have paid. Although a court judgment is required to legally oblige credit card companies to reimburse you, often sending the letters contained in the kit can be enought to result in them reimbursing you. If not, the company's failure to respond may strengthen your case if you do decide to issue court proceedings.

The template letters in the kit can be used to request that your charges be returned to you. The charges must have been incurred between 2000 and 2006.
Please note that reclaiming your unfair credit card charges is not the same as requesting your credit card issuer to write off your credit card balance.
