Reclaim Credit Card Charges Kit
It is estimated that credit card issuing companies have already paid out over half a million Pounds in unfair credit card charges. Reclaiming your unfair credit card charges is not the same as requesting your credit card issuer to write off your credit card balance.
The Office of Fair Trading ruled in 2006 that penalty charges and fines for credit cards were unfair. Unlike reclaiming bank charges, credit card reclaiming is not currently on hold. In England and Wales you can reclaim up to six years of credit card charges and fines. In Scotland you can go back up to five years. These time limits are set by the law.
The credit card penalty charges and fines you may reclaim include late payment interest and fees incurred for going over your credit limit. You cannot reclaim standard account fees or interest using this letter.
If you do not have in your possession the previous year’s credit card statements, you are legally entitled to request copies of these from the credit card companies under the Data Protection Act 1998. The credit card companies may charge you a nominal fee for administration. Using our template letter, you can contact your credit card company detailing your past charges to request a reclaim on these charges.
A report published by the Office of Fair Trading in April 2006 concluded that credit card charges over £12 were unfair. This resulted in many credit card companies lowering their penalty charges to £12. The result of this in relation to reclaiming is that if you incurred credit card penalty charges of, for example, £35, you may only receive the difference between your charge and the £12, which would result in a £23 reclaim. However, you can push harder to get the full amount refunded or complain to the Financial Ombudsman.
Charges incurred before June 2006 were generally set at £30. Due to this figure, it is likely that you will receive the difference between this charge and the recommended £12. Charges incurred after June 2006 were generally set at £12. This means that you may reclaim the full £12.
Credit card companies have been repeatedly accused over the last seven or more years of having unlawful charges. Consumers have launched numerous cases and the United Kingdom courts have begun to take notice. Last year in 2008 a court proceeding continued in which favour was on the behalf of the consumer. A court decision a few years earlier stated that consumers could recoup unfair charges from credit card companies.
Then an appeal was made from the credit card companies, which has frozen the money. There are literally thousands and thousands of pounds owed to consumers that have been unreachable. Luckily the reclaim credit card charges kit provided on this site gives you a method for going after the unfair charges you had to pay. Right now the only charges you can reclaim are those that have already been awarded by the courts.
However, you also have the option of entering into a court case with the credit card company to try and recoup other charges you have seen. The kit will allow you to send letters to the credit card company showing your intent to bring them to court. They will have to answer your letter with how they wish to proceed. A failure to answer in an appropriate time can strengthen your court case. In some cases the letter kits have returned the money without the need to appear in court.
The template letters in the kit will first ask that your charges be returned to you. The charges have to fall into the 2000 to 2006 period. Any charges after this time have not yet been awarded by the courts. The charges you can reclaim by the kit will range between £12 and £30, which is a lot of money you could be using for other things.
